Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you ("User") and Revive Solutions regarding your use of the Mind Blazer Arcade mobile application and any related websites, APIs, and services (collectively, the "Service").

By creating an account, downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you are under the age of legal majority in your jurisdiction, a parent or legal guardian must read, accept, and supervise your use of the Service on your behalf.

2. Eligibility

  • The Service is available to users who are at least 6 years old.
  • Users under 13 (or under the applicable digital-consent age in the EEA) require verifiable parental consent to register, as described in our Privacy Policy.
  • A parent/guardian who registers a child account is responsible for that child's compliance with these Terms.

3. Accounts

  • You must provide accurate registration information and keep it up to date.
  • You are responsible for maintaining the confidentiality of your password.
  • You must promptly notify us at [email protected] of any unauthorised use of your account.
  • We may suspend or terminate accounts that violate these Terms or applicable law.

4. License Grant

Subject to these Terms, Revive Solutions grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service on a personal device that you own or control, solely for your personal, non-commercial use.

5. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract the source code of the Service, except where allowed by law.
  • Use the Service for commercial resale, redistribution, or to build a competing product.
  • Upload content that is unlawful, harmful, harassing, obscene, or that infringes another person's rights.
  • Attempt to gain unauthorised access to any account, server, or data.
  • Use automated means (bots, scrapers) to access the Service.
  • Misrepresent your age or impersonate another person.
  • Resell, sublicense, or redistribute the Service or any part of it, or use it to operate a paid service, instructional session, or therapy session for third parties.
  • Use the Service to develop a competing product or to benchmark for a competing product.

6. User Content

The Service allows you to enter limited content (mood notes, custom avatar, tasks, support messages). You retain ownership of your content. You grant us a worldwide, royalty-free license to host, store, reproduce, and display that content solely as needed to operate the Service for you.

You are solely responsible for the content you enter and confirm you have the right to enter it.

7. Intellectual Property

All rights in the Service — including software, designs, game art, sound, copy, logos, and the "Mind Blazer Arcade" name and marks — are owned by Revive Solutions or its licensors and are protected by copyright, trademark, and other laws. Nothing in these Terms transfers any of those rights to you.

Third-party libraries and assets used in the Service are licensed under their respective open-source or commercial licenses; see the in-app Licenses screen.

8. In-App Purchases & Subscriptions

If the Service offers paid features or subscriptions:

  • Payments are processed by Apple App Store or Google Play.
  • Prices, billing cycles, and renewal terms are disclosed before purchase.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period through the platform's settings.
  • Refunds are governed by the platform's policy.
  • No in-app purchases are offered to users under 13.

9. Not Medical Advice

Mind Blazer Arcade is a casual arcade game, not a medical device. It does not provide medical advice, diagnosis, or treatment, and is not a substitute for the advice of a qualified professional. If you're in distress, contact your local emergency services.

10. Modifications to the Service

We may add, modify, or discontinue features at any time. We will give reasonable notice of material changes that adversely affect existing users.

11. Termination

You may stop using the Service at any time and delete your account from Settings → Account, or per Account & Data Deletion.

We may suspend or terminate access if you (a) materially breach these Terms, (b) create risk or legal exposure for us or other users, or (c) where required by law. Where reasonable, we will give notice and an opportunity to remedy.

Upon termination:

  • Your license to use the Service ends immediately.
  • We will delete your personal data per the retention schedule in the Privacy Policy.
  • Sections that by their nature should survive (IP, disclaimers, limits of liability, governing law) will survive.

12. Disclaimers

The Service is provided "as is" and "as available" without warranty of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or effective for any particular user's gameplay goals.

Some jurisdictions do not allow the exclusion of certain warranties; in that case, the above exclusions may not apply to you.

13. Limitation of Liability

To the maximum extent permitted by law:

  • Revive Solutions will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, or goodwill.
  • Our total aggregate liability for all claims arising out of or relating to the Service in any 12-month period is limited to the greater of (a) the amount you paid us for the Service in that period, or (b) USD 50.

Nothing in these Terms limits liability for fraud, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

14. Indemnity

You agree to defend and indemnify Revive Solutions, its officers, employees, and contractors from any third-party claim arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) content you submit. This Section does not apply to consumer users where prohibited by law.

15. Apple App Store EULA Addendum

If you obtained the App from Apple's App Store, the following additional terms apply (Apple's required EULA terms):

  • These Terms are between you and Revive Solutions, not Apple. Apple is not responsible for the App or its content.
  • Your license to use the App is limited to use on Apple-branded products you own or control, per the Apple Media Services Terms.
  • Apple has no obligation to provide maintenance or support for the App.
  • Revive Solutions — not Apple — is responsible for any product warranties.
  • Revive Solutions — not Apple — is responsible for addressing any claim that the App or your possession/use of it infringes a third party's IP.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • You confirm you are not located in a U.S.-embargoed country and are not on any U.S. Government restricted-parties list.

16. Google Play Addendum

If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service, the Google Play Families Policy (where applicable), and the Google Play Developer Distribution Agreement to the extent it applies to you.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of India (Bhubaneswar / Cuttack jurisdiction), without regard to conflict-of-laws rules. Mandatory consumer-protection laws of your country of residence still apply.

The parties will first try to resolve any dispute informally by contacting [email protected]. If unresolved within 30 days, disputes will be submitted to the exclusive jurisdiction of the competent courts in Bhubaneswar, Odisha, India, except where applicable law grants you the right to bring proceedings in your local courts.

18. Miscellaneous

  • Entire agreement: These Terms (with the Privacy Policy and any addenda) form the entire agreement between you and us regarding the Service.
  • Severability: If any provision is held unenforceable, the remainder remains in force.
  • No waiver: Our failure to enforce any right is not a waiver of it.
  • Assignment: You may not assign these Terms; we may assign them to an affiliate or in connection with a merger or sale of assets.
  • Notices: We will notify you in-app or by email. You may contact us at [email protected].
